Denver Public Schools Refuse Federal Demands to Target Trans Students

Facing a ultimatum from the Trump administration, Denver Public Schools has vowed to defy federal demands to dismantle gender-neutral restrooms and roll back protections for transgender students. The district now risks losing 7% of its annual budget, a significant portion of which funds school lunches for low-income children.

Superintendent Alex Marrero confirmed the district will not implement the Department of Education's mandate, which includes removing multi-stall, gender-neutral facilities and adopting biological definitions for gender. The Office for Civil Rights issued the ultimatum last Thursday, citing Title IX and threatening to pull federal funding if the district does not comply within 10 days.

In a formal statement, the district board argued that Title IX allows for sex-separate restrooms but does not mandate them as the exclusive option. Officials emphasized that the current facilities, which feature 12-foot partitions, were installed specifically to address student reports of feeling unsafe. Marrero pledged to fight the administration in court if necessary, asserting that the district’s primary duty is to ensure all students can learn without fear.

This act of defiance mirrors legal battles currently playing out in Virginia, where five school districts have sued the federal government over similar directives. While several major universities and hospitals have already moved to comply with the administration's stance, Denver’s leadership maintains that their commitment to student equity remains non-negotiable.
