The lawsuit, Pearson et al. v. Amazon Data Services, Inc., contends that nitrate contamination in Morrow and Umatilla counties poses significant environmental and health risks to those relying on local water sources. While Amazon Data Services denies any wrongdoing or liability, the agreement establishes a fund to address water quality through both private and public infrastructure improvements.

Amazon Data Services Reaches $20.5 Million Nitrate Pollution Settlement
Residents and property owners within Oregon’s Lower Umatilla Basin Groundwater Management Area may soon receive relief following a $20.5 million settlement in a class action lawsuit. The litigation targets Amazon Data Services over allegations that wastewater from regional data centers contributed to hazardous nitrate levels in local groundwater.

Eligible class members who rely on private wells may receive funding to extend or modify their systems to reach the cleaner basalt aquifer, provided their water meets specific contamination thresholds. Separately, the settlement allocates resources for public infrastructure, including pipeline extensions, utility upgrades, and enhanced wastewater treatment processes. Residents wishing to opt out of the settlement must submit their requests by September 8, 2026, while formal objections are due by October 8, 2026. A final fairness hearing is scheduled for January 12, 2027, in the U.S. District Court for the District of Oregon.
