Washington state judge John McHale has ruled that Kalshi’s online prediction-market platform likely violates local gambling statutes. The preliminary injunction, expected to be formalized by August 5, marks a significant legal setback for the company as it faces mounting pressure from state regulators across the country.

McHale’s decision emphasizes that the state has established a well-grounded fear regarding the immediate invasion of consumer rights. While the company maintains that its operations remain outside state purview, the court rejected the notion that federal oversight by the Commodity Futures Trading Commission preempts local gambling laws. The judge noted that specific transaction types can remain permissible in some jurisdictions while staying prohibited in others.

This ruling arrives amid a broader regulatory clash between state attorneys general and the Commodity Futures Trading Commission. The federal agency, led by chair Michael Selig, has consistently asserted exclusive authority over these markets, challenging state-level enforcement efforts in New York, Arizona, Illinois, and Connecticut. Kalshi representatives expressed disappointment, arguing that previous court precedents from the Third Circuit support their position that states lack jurisdiction to regulate these prediction platforms.
