FTC Accuses Hims & Hers of Funneling Patient Data to Tech Giants

The Federal Trade Commission has launched a legal challenge against Hims & Hers, alleging the telehealth provider secretly funneled sensitive patient health data to advertisers, including Meta and Snap. The suit further claims the company misled customers regarding its privacy protections and engaged in deceptive billing practices.

The complaint, filed in a California federal court, asserts that the publicly traded company integrated pixel-sized trackers from various tech giants—including Microsoft, Pinterest, Reddit, and X—onto its platform. These tools allegedly captured specific health information and user interaction data, directly contradicting the privacy assurances Hims & Hers provided to its subscribers. Beyond data privacy concerns, the FTC flagged the company’s subscription architecture, alleging that internal policies were intentionally designed to obstruct customers from canceling their services.

Hims & Hers responded by defending its privacy framework, asserting that users maintain control over their data usage, and confirmed its intent to challenge the allegations in court. This enforcement action continues a broader regulatory trend targeting telehealth and digital health providers. The FTC has recently pursued similar cases against Cerebral, Monument, GoodRx, and BetterHelp, all of which faced accusations of exposing sensitive patient information to third-party advertising ecosystems through website tracking code.
