Minnesota law targeting 'nudify' apps survives xAI legal challenge

A federal judge has cleared the path for Minnesota to implement the nation’s first ban on AI-driven image manipulation apps, dismissing an eleventh-hour attempt by xAI to halt the legislation. U.S. District Judge Donovan Frank ruled that the company’s delay in filing suit undermined claims of immediate, irreparable harm.

The statute, which takes effect August 1, faces ongoing scrutiny as the broader lawsuit proceeds. In his order, Frank highlighted that xAI waited nearly three months after the law’s signing to request a temporary restraining order, filing the motion just three days before the deadline. While the court denied the immediate block, the underlying constitutional challenge remains active, with xAI contending that the measure is overly broad and ignores less restrictive regulatory alternatives.

The legislation emerged following a series of controversies involving Elon Musk’s social media platform, X. Earlier this year, users leveraged the platform’s Grok chatbot to generate and circulate non-consensual sexualized imagery, sparking widespread backlash and regulatory investigations. This state-level ban represents a significant attempt to curb the proliferation of such content, setting a legal precedent that tech companies are now forced to navigate in court.
