Chipotle Faces First Lawsuit Over Multistate Salmonella Outbreak

A sixteen-year-old boy has filed suit against Chipotle Mexican Grill after contracting a Salmonella infection that resulted in a permanent diagnosis of ulcerative colitis. The legal action, filed in Montana, marks the beginning of expected litigation tied to a multistate outbreak linked to contaminated jalapeños served at the chain.

The plaintiff, identified as H.S., visited the Chipotle restaurant at 1919 W. Main Street in Bozeman on July 9, 2026. Within five days, he began suffering from severe nausea, fever, and abdominal distress. Medical intervention at the Bozeman Health Deaconess Regional Medical Center confirmed a Salmonella infection, which doctors say triggered the chronic inflammatory bowel condition now requiring lifelong management.

Health authorities have traced the source of the illnesses to jalapeños supplied to Chipotle restaurants across several states. In Minnesota alone, officials identified 110 cases, with 75 of those interviewed reporting recent meals at the chain. While Chipotle has since removed the implicated peppers from its inventory, replacing them with products from different growers, the legal fallout is only beginning. The complaint alleges that the company failed to implement necessary safety testing and neglected to warn the public despite early signs of contamination.

Attorney Ron Simon, representing the plaintiff, emphasized that the company’s focus on fresh ingredients is compromised by failures in the supply chain. The lawsuit seeks damages for strict product liability and negligence, asserting that the food served was adulterated under state and federal regulations. With federal investigators from the FDA and CDC currently tracking the origins of the outbreak, the firm has established a dedicated claim center for other affected individuals, anticipating that this filing will be the first of many.
