Former PROCEPT Executive Named in Securities Fraud Class Action

Former PROCEPT BioRobotics Chief Commercial Officer Hisham Shiblaq has been named as a defendant in a pending securities class action. The lawsuit alleges that investors suffered losses exceeding 75% of share value following claims that the company misrepresented procedure demand and inventory levels throughout the recent Class Period.

The legal action, filed in the U.S. District Court for the Northern District of California, centers on allegations that PROCEPT BioRobotics masked a discrepancy between handpiece sales and actual clinical usage. Plaintiffs contend that an undisclosed discount program incentivized bulk orders that artificially inflated the company’s commercial performance metrics. According to the complaint, Shiblaq, who served as Chief Commercial Officer from 2019 until his departure in September 2025, played a central role in communications regarding surgeon adoption and procedure volume while the company purportedly accumulated excess field inventory.

Investors report that PROCEPT shares dropped from a peak of approximately $100.00 to under $25.00 as the market reacted to disclosures concerning internal discounting and shipment trends. Levi & Korsinsky, LLP, the firm representing the plaintiffs, stated that the case focuses on whether senior leadership provided a misleading narrative regarding the company's recurring revenue model. Under Sections 10(b) and 20(a) of the Securities Exchange Act, the court will examine the extent of executive control over public statements that influenced the market price of PRCT stock. Affected shareholders have until September 22, 2026, to apply for lead plaintiff status.
