Hims & Hers Health Investors File Class Action Following FTC Complaint

A federal investigation into Hims & Hers Health has triggered a securities class action lawsuit, alleging the telehealth company misled investors regarding its data privacy safeguards and subscription billing practices. The legal challenge follows a sharp market sell-off that erased nearly $1 billion in the company’s valuation this past July.

The lawsuit, filed by Hagens Berman, targets the period between August 4, 2025, and July 29, 2026. Plaintiffs contend that the company repeatedly assured stakeholders of robust administrative and technical protections for sensitive health data, while simultaneously sharing personal medical information with third-party advertising platforms like Meta and Snap. Regulators, including the FTC, the State of Utah, and the County of Los Angeles, allege that these disclosures occurred via embedded tracking pixels, directly contradicting the firm’s public-facing privacy marketing.

Beyond privacy concerns, the complaint highlights potential violations of the Restore Online Shoppers' Confidence Act. It asserts that Hims enrolled users in recurring subscription models without informed consent, often processing payments immediately after intake forms were submitted—before a medical consultation even occurred. The legal action further argues that the company utilized "dark patterns" to complicate the cancellation process, effectively trapping consumers in unwanted subscriptions. Following the disclosure of these regulatory complaints on July 29, 2026, Hims shares fell by $4.32, a 14.7% decline that wiped out approximately $970 million in market capitalization. Reed Kathrein, a partner at Hagens Berman, stated the firm is investigating whether Hims intentionally misled investors about the adequacy of its internal controls and the potential financial penalties resulting from this conduct. The deadline for investors to apply for lead plaintiff status is November 2, 2026.
