The litigation, filed by Schall, Brown & Schwartz LLP, alleges the company misled shareholders regarding the insurance coverage timeline for its product, neffy.

The complaint centers on claims that ARS Pharmaceuticals provided false or misleading guidance concerning the integration of its drug, neffy, into the CVS Caremark formulary. Plaintiffs allege that the company recklessly disregarded risks associated with shifting insurance coverage schedules, which directly impacted the product's commercialization prospects. When these realities surfaced, the subsequent market reaction resulted in financial losses for shareholders.

Attorneys Brian Schall and David Schwartz are leading the outreach for the firm, which operates out of Los Angeles. While the class has not yet been certified by the court, investors who suffered losses during the specified period may seek to serve as lead plaintiffs. Participation in the lawsuit does not require an appointment as lead plaintiff, though those who remain inactive will be treated as absent class members should the case proceed.
