Plaintiffs contend the company also fabricated the volume of trading occurring on its platform. Beyond operational claims, the suit highlights undisclosed associations with convicted felon Edward Withrow III and the prior SEC charges against CEO Nathaniel T. Bradley, arguing these factors presented significant, hidden reputational risks.

Scrutiny intensified on October 31, 2025, when Wolfpack Research released a report characterizing the company's AI, quantum computing, and Web3 claims as deceptive. The report alleged that the firm's partnerships lacked the projected economic upside and that platform activity was effectively non-existent. Following the report's publication, Datavault shares plummeted 19%, dropping from $2.52 to $2.03 in a single day. Investors seeking to serve as lead plaintiffs in the Berger Montague action must file by the early October deadline.
