A securities class action lawsuit has been filed against FuelCell Energy, Inc. following allegations that the company misled investors regarding its manufacturing capacity and ability to meet contractual obligations. The litigation centers on a 380-megawatt deal that reportedly failed to account for significant production shortfalls and subsequent financial charges.

The complaint, filed on behalf of shareholders who purchased stock between June 24 and September 1, 2026, claims that management failed to adequately warn investors of the risks associated with the Fit Energy USA LP agreement. While the company initially touted the deal as a milestone validating a move toward 500 MW of capacity, reality diverged sharply when the company reported a fiscal third-quarter net loss of $45.3 million.

Central to the lawsuit is the disclosure of a $17 million charge tied to production inefficiencies. According to the filing, the company’s manufacturing capacity was insufficient to meet the production rates required by the Fit Energy contract, leading to overhead costs that exceeded established pricing. When these figures emerged on September 2, 2026, FuelCell Energy shares dropped 15.69% in a single session. Investors now have until November 10, 2026, to apply for lead plaintiff status in the ongoing legal proceedings.
