Plaintiffs claim the company abandoned its traditional policy of not hedging mortgage servicing rights, instead taking on significant, undisclosed risk while anticipating a transaction with Two Harbors Investment Corp. That deal collapsed after a competing offer emerged, leaving UWM with an excess hedging position.

The financial impact became clear on August 5, 2026, when UWM reported a $603.2 million loss tied to interest rate derivatives, contributing to a total quarterly net loss of $451.9 million. Following the disclosure and subsequent comments from CEO Mathew Ishbia admitting the company was over-hedged, UWM share prices dropped nearly 35%.
