Investors who incurred financial losses holding FuelCell Energy, Inc. securities between June 24 and September 1, 2026, have until November 10 to petition the court to serve as lead plaintiff in a newly filed class action lawsuit alleging the company misled shareholders regarding its manufacturing capabilities.

The complaint, spearheaded by the law firm Glancy Prongay Wolke & Rotter LLP, centers on claims that FuelCell Energy failed to disclose critical operational shortcomings. The lawsuit alleges that the company’s manufacturing capacity was insufficient to meet production requirements mandated by its agreement with Fit Energy. According to the filing, this shortfall led to slower delivery rates, inflated production costs, and higher overhead expenses, all of which were allegedly omitted from public statements during the class period.

Plaintiffs argue that these undisclosed trends negatively impacted the company’s profitability and undermined the integrity of the positive projections shared with the market. While the court has yet to certify a class, investors who purchased shares within the specified timeframe may participate in the litigation. Those interested in seeking recovery or serving as a lead plaintiff must file their motions by November 10, 2026. Legal representatives note that shareholders retain the right to choose their own counsel or remain passive members of the class should a suit be certified.
