Judge Challenges Pentagon’s Attempt to Blacklist Anthropic

The legal confrontation arises from a breakdown in contract negotiations between Anthropic and the Department of Defense. Anthropic maintains that its artificial intelligence should not be deployed for mass surveillance or lethal target selection, citing concerns over technological readiness. Conversely, the Pentagon argues that private contractors cannot dictate military usage policies, asserting that its internal protocols ensure lawful operation of the tools.

Judge Lin expressed alarm at the government’s justification for the ban, which partially relied on Anthropic’s public criticism of the Defense Department. She warned that penalizing contractors for voicing policy disagreements could create a dangerous precedent for federal oversight. Furthermore, the court dismissed Pentagon claims that Anthropic holds the capability to remotely disable or alter its AI models during active conflict, noting an absolute absence of proof for such a 'kill switch' scenario. Lin is currently deciding whether to make permanent her March injunction that temporarily blocked the government's restrictive designation.
